(a) The Secretary of Health or any other Commonwealth or municipal officer in charge of the public health services, in agreement with the Secretary of Health, shall determine when the rendering of additional medical, pharmaceutical or dental services beyond the regular working hours is justified, taking into consideration the difficulty of hiring this personnel in some towns of the Island, the number of patients to be attended, the location of the medical, pharmaceutical or dental facilities and the need of rendering medical, pharmaceutical or dental services on night shifts, holidays and weekends. Once this determination has been made, the Secretary shall authorize the rendering of such additional services by paying the additional compensation entailed by such services as provided in subsection (b) of this section.
(b) The Secretary of Health shall, jointly with the Director of the Personnel Office, fix the additional compensation within the corresponding schedule to be paid in these cases, taking into consideration upon establishing same the reasonable value of the services.
(c) The additional payments authorized herein for services rendered after regular working hours do not exclude nor substitute the payment of higher salaries for regular work when these salaries are established in specific localities by reason of the extraordinary difficulties in hiring personnel for such services.
