The Commonwealth of Puerto Rico shall be civilly liable for damages for defects, lack of repairs or lack of enough protection to the traveler in any thoroughfare belonging to the Commonwealth and under the responsibility of the Department of Transportation and Public Works, except whenever it is proven that the referred [sic] defects were caused by the violation of the elements, and that there was not sufficient time to remedy them.
The amount of the indemnifications granted by courts by virtue of this Section, shall be limited to the provisions of § 3077 of Title 32.
