§ 8881. Definitions

(a) Program Administrator.— Shall mean the Committee created in this chapter, which shall be chaired by the Secretary of the Department of Labor and Human Resources of the Government of Puerto Rico. The other members of the Committee shall be the Director of the Office of Management and Budget and the Administrator of the Government of Puerto Rico Employees Retirement System, who shall direct the retirement phase.

(b) Agencies.— Shall include all agencies, departments, offices, commissions, boards, administrations, bodies, and any other instrumentalities of the Executive Branch of the Government of Puerto Rico, whose budget is defrayed, in whole or in part, by the General Fund as of the effective date of this act, whether or not the provisions of §§ 1461 et seq. of this title, apply to them.

(1) Public or public-private corporations or instrumentalities operating as private companies or businesses with their own funds;

(2) the University of Puerto Rico;

(3) the Commonwealth Elections Commission; and

(4) the Puerto Rico Government Ethics Office, shall be excluded from the definitions and applicability of this chapter.

(c) Appointing authority.— Shall mean any head of agency with legal authority to make appointments for positions in the Government.

(d) Department of Labor.— Shall the mean Department of Labor and Human Resources of Puerto Rico.

(e) Eligible employee.— Shall mean any career employee of an agency who is not barred from participating in the Program, as provided in § 8896 of this title.

(f) Effective date to participate in the incentivized retirement and retraining program.— Shall mean the work day following the date on which the participant shall cease to discharge the functions of his/her position in the Government agency, as provided in § 8893 of this title.

(g) Government.— Shall mean the Government of Puerto Rico.

(h) Opting period.— Shall mean the thirty (30) -day period established by the Administrator on or before October 30, 2010, or any additional thirty (30) -day grace period established by the Program Administrator, on or before December 31, 2012, during which any eligible career employee of an agency may irrevocably opt to avail him/herself of the Program during the effectiveness of this act.

(i) Program.— Shall mean the Incentive, Retirement, and Retraining Program created in this chapter.

(j) Participant.— Shall mean any eligible employee of an agency who, on or before the expiration of the opting period, avails him/herself of the benefits of the Program.

(k) Salary.— Shall mean the gross compensation earned by an employee for services rendered to an agency at the time of choosing to participate in the Program. When computing the salary, any bonus in addition to the salary, any payment on account of special working hours, and the costs of fringe benefits, shall be excluded. This definition of salary shall be used to determine the benefits of subsections (a) and (b) of § 8883 of this title, and shall prevail over any definition in the law or regulations.

(l) ORHELA.— Means the Human Resources Office of the Commonwealth of Puerto Rico.

(m) OMB.— Means the Office of Management and Budget, attached to the Office of the Governor.

(n) Retirement System.— Shall mean the Government Employees Retirement System and the Teacher’s Retirement System.
