§ 4909. Escape

Any person who is lawfully under preventive custody, imprisonment, restriction of freedom or interned as a security measure, or undergoing treatment and rehabilitation in a program of the Commonwealth of Puerto Rico or a private program, supervised and licensed by a Commonwealth agency, or under a special diversion procedure under Rule 247.1 of the Rules of Criminal Procedure, or under a special law, and escapes or evades the legal custody exercised over him/her by another person with legal authority and any other person acting jointly with same shall incur a fourth degree felony.

The punishment shall be imposed in addition to the punishment corresponding to the other crime or the sentenced being served. No alternative punishment to imprisonment shall be available for this crime.
