If the emphyteuticary should have obtained permission from the legal owner for the alienation, or should have given him the previous notice prescribed in § 4220 of this title, the legal owner cannot demand the payment of laudemio except within a year following the day on which the public instrument is entered in the registry of property. With the exception of these cases this action shall be subject to ordinary prescription.
