If the heir should not have in his possession the inheritance or a part of it, or has not taken any steps as such heir, the periods fixed in the preceding section shall be counted from the day following that on which the period fixed by the Court of First Instance for accepting or repudiating the inheritance expires, in accordance with § 2787 of this title, or from the day on which he may have accepted it or has acted as heir.
