Should the heir repudiate the inheritance to the prejudice of his own creditors, the latter may request the part of the Court of First Instance having jurisdiction to authorize them to accept it in the name of the former.
The acceptance shall be of benefit to the creditors only insofar as it covers the amount of their credits. The excess, should there be any, shall not belong in any case to the renouncer, but shall be awarded to the persons to whom, according to the rules of this Code, it may pertain.
