Every violation of §§ 1476 and 1477 of this title shall be heard in a summary proceeding in which the defendant shall be allowed two (2) days to answer the complaint and make the allegations he may deem pertinent. The hearing shall be held within the five (5) days following the defendant’s answer.
Any person violating the provisions of §§ 1476 and 1477 of this title shall be guilty of a misdemeanor and, upon conviction thereof, shall be punished as follows: (a) if it is the investigation of a misdemeanor, by a maximum fine of five hundred (500) dollars or imprisonment in jail for a term not exceeding six (6) months, or both penalties, in discretion of the court; (b) if it is the investigation of a felony, by a fine of not less than one thousand (1,000) nor more than five thousand (5,000) dollars or imprisonment in jail for a term of not less than one (1) year nor more than ten (10) years, or both penalties, in the discretion of the court.
