A lease contract with a purchase option shall not include a provision:
(1) Requiring a judgment by consent.
(2) Authorizing a lessor or an agent of the lessor to commit a breach of the peace when repossessing the leased property.
(3) Waiving a defense, counterclaim, or right that the lessee could have against the lessor or an agent of the lessor, or any assignee of the lessor.
(4) Requiring payment of late charges unless the lease payment is in arrears for more than three (3) working days, and the charges shall not be for an amount greater than ten percent (10%) of the lease payment in arrears, or three dollars ($3.00), whichever is less.
(5) Requiring a separate payment in addition to the lease payments needed to become the owner of the property, without including those related to the exercise of an early purchase option, as provided in § 2459 of this title.
(6) Requiring a waiver of any action against the lessor or the holder of the lease contract with a purchase option, or other person acting as such, for an illegal act committed when collecting the payment under the lease contract with a purchase option, or upon the repossession of items.
