Any person or entity violating any of the provisions of §§ 231—236 of this title shall be guilty of a misdemeanor and shall, upon conviction thereof, be punished by imprisonment in jail for a term of not more than three (3) months, or by a fine of not more than five hundred dollars ($500), or by both penalties, in the discretion of the court. In case of recidivism, the penalty shall be imprisonment in jail for a term of not more than one (1) year, or a fine of not more than one thousand dollars ($1,000), or both penalties, in the discretion of the court.
