The Commissioner, with prior notification and administrative hearing, may impose and collect administrative fines from any credit repair agency for any violation of this chapter or any applicable regulations, orders or resolutions approved and issued by the Commissioner. The administrative fines shall not be of less than five hundred dollars ($500) nor of more than ten thousand dollars ($10,000) per violation of this chapter or the regulations promulgated thereunder.
When the nature of the violation of this chapter or any rules, regulations, orders or resolutions issued by the Commissioner so justify, in addition to the administrative fines authorized in the preceding paragraph, the Commissioner shall file criminal charges against the offender.
