§ 74. Condemnation of property

The Secretary of Transportation and Public Works is hereby authorized to file and prosecute in the name and in behalf of the Commonwealth of Puerto Rico, all proceedings relative to the condemnation of lands and the accessories thereof, quarries, properties, and any other rights, for the construction, reconstruction and widening of roads, highways, bridges, side-roads, junctions, variants, and routes in urban and rural districts, as well as parks and recreation places in the surroundings of said roads.

When it may be necessary, in order to carry out any of the aforesaid works, to purchase or condemn part of a parcel and building, the Secretary of Transportation and Public Works may purchase or condemn the whole of the parcel and the whole of the building; the Secretary of Transportation and Public Works may, likewise, substitute the works by others, or when necessary, construct the works in such way, that the affected party may continue to enjoy the facilities previously had or the equivalent thereof, as the case may be, if in his judgment the best interests of the Commonwealth of Puerto Rico would thereby be better served.
