§ 3206. Obligations—Secretary of Transportation and Public Works

The Secretary of Transportation and Public Works shall provide the Puerto Rico Police with the information in his/her power relative to the those vehicles authorized by the Department of Transportation and Public Works to travel along the public highways of Puerto Rico so that the Police may comply with its duty to protect property. In order to comply with this task, the Secretary of Transportation and Public Works shall provide a link between the information systems of his/her agency and the Puerto Rico Police and authorize the installation of electronic terminals through which the Police may continuously obtain during twenty-four (24) hours a day, the information contained in the Motor Vehicles Registry.

Said information shall include, among other particular items, the following:

(1) Description of vehicle including trademark, year, model or type, color, license plate number, body serial number, engine number, registration number, engine type, effective horsepower, license sticker number, number of doors and any other number or identification mark of the unit or its parts.

(2) The name and address of the dealer, entity or person who sells or in any way transfers, alienates or encumbers the vehicle.

(3) The name and address of the owner or purchaser of the vehicle.

(4) The date of the first registration in the Register of the Department of Transportation and Public Works.

(5) The type of transaction, date of sale, transfer or confiscation and the date of registry of these transactions.

(6) Annual license fees paid and the fiscal year covered by such fees.

(7) Type of financing, name and address of the financing entity or company and place of registry of the financing, if any.

(8) Name and address of the insurance company, if there is one.

(9) The changes in the Transportation and Public Works Register that take place due to the repair of vehicles or by a declaration of total loss or abandonment.

(10) Any other information in his possession that is pertinent to the discharge of his obligations pursuant to this chapter.

Without prejudice or impairment to the provisions or obligations set forth in other laws, the Secretary of Transportation and Public Works shall be bound to establish and maintain an updated Register of Non-Resident Sales Dealers of Motor Vehicles and Trailers. The same shall include all information relative to the certification of non-resident dealers engaged in the retail sale of motor vehicles or trailers as part of an enterprise, business, company or dealership issued by the state or territory of the United States or by the foreign country where they conduct their operations; the name of those persons authorized to participate in the bidding procedures held by redistributors of motor vehicles or trailers in Puerto Rico; a copy of the driver licenses of said persons, in case they are residents of any state or territory of the United States and a copy of the passports of said persons, in case they are residents of a foreign country.
