§ 3201. Definitions

The following terms shall have the meaning expressed below, unless otherwise clearly indicated in the context of this chapter:

(a) Agent of public law and order.— Means an agent of the Puerto Rico Police, the Special Investigations Bureau, or Internal Revenue Agents of the Department of the Treasury.

(b) Motor vehicle.— Means every self-propelled vehicle except the following or similar vehicles:

(1) Traction machinery

(2) Road rollers

(3) Tractors used exclusively for agricultural purposes

(4) Power shovels

(5) Road construction equipment

(6) Deep-well drilling machines

(7) Vehicles with small wheels used in factories, warehouses and railroad stations

(8) Vehicles that travel on rails, on the sea or through the air.

(c) Ridiculous price or value.— Means a low sales price which is out of proportion with the regular sales price for a vehicle or part in the current market.

(d) Secretary.— Means the Secretary of Transportation and Public works.

(e) New motor vehicle.— Any motor vehicle which has not been registered to the name of any person whatsoever within the jurisdiction of the Commonwealth of Puerto Rico, any state of the United States of America, or any foreign country.

(f) Sales dealer of motor vehicles, trailers and semi-trailers.— Means any natural or juridical person who is totally or partially engaged in the retail sale of motor vehicles, trailers, and semi-trailers and who sells motor vehicles, trailers, or semi-trailers for profit, as part of an enterprise, business, dealership, or company in Puerto Rico and is duly authorized to do so. Said term excludes financial institutions, insurance companies, or leasing companies.

(g) Non-resident sales dealer of motor vehicles, trailers, and semi-trailers.— Means any natural or juridical person who is totally or partially engaged in the retail sale of motor vehicles, trailers, or semi-trailers and who sells motor vehicles, trailers, or semi-trailers for profit as part of an enterprise, business, company, or dealership in any state of the United States or in any foreign country and is duly authorized to do so. Said term excludes financial institutions, insurance companies, or leasing companies.

(h) Redistributor of motor vehicles, trailers, or semi-trailers.— Means any natural or juridical person authorized to redistribute motor vehicles, trailers, or semi-trailers owned by financial institutions, insurance companies, leasing companies, or sales dealers of motor vehicles, trailers, or semi-trailers through bidding procedures whereby the same are passed on to sales dealers of motor vehicles, trailers, or semi-trailers, including non-resident sales dealers.

(i) Dealer of motor vehicle, trailer, and semi-trailer financing accounts.— Means any natural or juridical person who is totally or partially engaged in the purchase, receipt, sale, or alienation of motor vehicles, trailers, or semi-trailers subject to any financing or owed to any financing entity or creditor, and who sells, transfers, or alienates the same as part of an enterprise, business, company, or dealership for profit in Puerto Rico and is duly authorized to do so. Said term excludes financial institutions, insurance companies, or leasing companies. The dealer shall transfer the title to his/her name at the time of purchasing or receiving the motor vehicle, trailer, or semi-trailer.
