No person shall extract stones, earth or any other material from the landslides, sides and ditches of the highways without the previous authorization of the Department, neither shall any person cut or excavate on the roadway for any purpose whatsoever without the said permit.
Any person who violates this provision shall be guilty of a misdemeanor and upon conviction punished by a fine of not less than twenty-five [dollars] ($25) nor more than five hundred dollars ($500).
