No person shall root out, cut or cause any damage to the plantings made on the highway for purposes of ornamentation, and should he do it, said person shall pay for the damages caused and shall, also, be guilty of a misdemeanor and upon conviction punished by a fine of not less than ten [dollars] ($10) nor more than fifty dollars ($50). The Secretary shall provide by regulation the proceeding for recovering the damages caused.
