Without the previous permission of the Secretary and the knowledge of the employee in charge of road maintenance no trees shall be planted, trimmed or felled within the right of way of the highways, neither shall trees be felled which, though on a private property, grow toward and shade highways, or whose felling may affect the structure of the highway.
Any person who violates this provision as to the trees within the zone of the highway shall be guilty of a misdemeanor and upon conviction punished by a fine of not more than one hundred dollars ($100). Violation of this section as to the trees on private property shall be a misdemeanor punishable by a fine of not more than fifty dollars ($50). In both cases the violator shall repair the damage caused and shall pay for the necessary labor to avoid further damages.
