§ 2302. Free flow of waters

The owners of lands contiguous to the highway shall not prevent the free flow of waters coming therefrom by digging ditches or causeways, raising the land on their property or obstructing the existing works or drainage. Contrariwise, the employees of the Department in charge of road maintenance may enter private lands upon previous notice to the owner, lessee, holder or occupant thereof to reopen and clean the ditches and trenches that facilitate the drainage of the sewers, tubes and bridges existing on the highway. If the persons above-mentioned refuse to authorize entrance to the lands for the aforesaid purposes, any judge of the Court of First Instance shall, upon presentation to him of an affidavit expressing the intent of the Department to enter said lands, issue an order addressed to the owner, lessee, holder or occupant thereof, commanding him to authorize any one (1) or more officers or employees of the Department to enter the property described in the affidavit for the purposes set forth in this section. Disobedience of this order shall be considered as contempt of the court issuing it and shall be punished as such.
