§ 2102. Definitions

The following terms shall have, for the purposes of this chapter, the meanings expressed below:

(a) Highway. — Any commonwealth public road for vehicular traffic constructed in accordance with any law of the Commonwealth of Puerto Rico or which, having been constructed by a Commonwealth or federal agency or public corporation, or by a municipality, has been legally transferred to the Department of Transportation and Public Works for its custody and maintenance. A highway is composed of the roadway zone, the walk, the right of way, as well as bridges, drainage works, signs, signals, protective barriers and all the protective structures necessary and convenient for the best vehicle traffic.

(b) Department. — Shall mean the Department of Transportation and Public Works.

(c) Walk. — Shall mean the lateral sides of a highway between the roadway zone and the ditch, or between the roadway zone and the adjacent private property where there is no ditch.

(d) Person. — Shall mean every individual, group of individuals, partnership, association, agency or public or private corporation, organization or business.

(e) Secretary. — Shall mean the Secretary of Transportation and Public Works.

(f) Right of way. — Shall mean the area of land occupied by the highway and shall include the roadway zone, walks, ditches and adjacent lands up to the boundaries with the private property.
