Rule 16. Prohibition

(a) Any person found to have engaged in conduct that injures or attempts to injure the bar examination process may be disqualified as an applicant to the practice of law, have his examination invalidated, or be disqualified from the practice of law if already admitted thereto, or be imposed any other adequate sanction [at] the discretion of the court.

Conduct that injures or attempts to injure the bar examination process includes, although is not limited to:

(1) Conduct not authorized by Rule 5(h) of this appendix and which violates the security of examination materials, such as:

(A) To take any examination material from the examination room;

(B) to reproduce or reconstruct any part of the bar examination;

(C) to aid in any way to reproduce or reconstruct any part of the bar examination;

(D) to sell, distribute, buy, receive or possess without due authorization any part of a previous bar examination that is being or will be administered.

(2) Conduct that violates the rules of the administration of the examination, such as, for example:

(A) Communicate with any other examinee during the bar examination process;

(B) to copy the answers of another examinee or to allow another examinee to copy one’s answers during the examination;

(C) to have, during the bar examination, books, notes, written or printed material, or data of any kind other than those distributed by the Board for the examination.

(3) Conduct that violates the process of accreditation such as:

(A) To forge or distort academic credentials or other information required to be admitted to the bar examination;

(B) to take the place of an examinee; or

(C) to have someone take the bar examination in another’s name.

(b) Except for the procedure established by Rule 10, no applicant may communicate, directly or through third persons, with any Board member regarding any matter related to the preparation, contents, administration, grading, and evaluation of the bar examination and his answers thereto.

Any applicant who violates this section shall be denied admission to the examination, or will be disqualified if already admitted to the test.
