§ 1853. Creation

The Puerto Rico Agricultural Services Administration, attached to the Department of Agriculture, is hereby created. This Administration shall operate as a legal entity, separate from the officials or employees and the agencies, instrumentalities, public corporations and political subdivisions of the Commonwealth of Puerto Rico.

The Secretary shall have all the powers and shall determine the Administration’s public policy. Provided, further, That he shall adopt the standards, rules and regulations needed to exercise such powers and to comply with the purposes of this chapter.

The Secretary shall appoint an Administrator with the Governor’s consent. He shall fulfill his duties at the Secretary’s will and shall represent the Administration in all its acts or contracts, in person or through an authorized representative.

The Secretary may delegate such power and duties he may deem necessary, except police power, on the Administrator who may, in turn, delegate on his authorized representative.
