§ 1123. Power of Secretary of Agriculture

The Secretary of Agriculture is hereby directed and empowered through himself or through his lawful representatives to:

(a) Administer and supervise the execution of §§ 1121—1125 of this title.

(b) Approve the necessary regulations for the enforcement of the provisions of §§ 1121—1125 of this title which shall be governed by the Rules and Regulations Act of 1958, former §§ 1041—1059 of Title 3.

(c) Take samples and make the necessary analyses to guarantee the enforcement of §§ 1121—1125 of this title.

(d) Enter into any establishment, under reasonable circumstances, and inspect any container, material, equipment, product, device or vehicle to guarantee the enforcement of §§ 1121—1125 of this title.

(e) Require to be supplied, for inspection, any record, book, document or printed material, to ensure the enforcement of §§ 1121—1125 of this title.

(f) Carry out such periodical inspections and investigations as he may deem necessary for uncovering violations of §§ 1121—1125 of this title.

(g) Receive complaints and provide for the investigation thereof.

(h) Provide for the filing of civil or criminal actions, or both, which may arise through violations of the provisions of §§ 1121—1125 of this title.
