§ 1114. Violations and penalties

(a) Any person violating or refusing or neglecting to comply with any provision of §§ 1092—1118 of this title, or of any regulation, order or resolution of the Administrator issued hereunder, with the exception of the violations contained in § 1097 of this title, shall incur a misdemeanor and be punished, upon conviction thereof, with a fine of not less than one hundred dollars ($100) nor more than five hundred dollars ($500) or confinement for a period no longer than six (6) months, or both penalties, at the discretion of the court.

(b) Any person violating or refusing or neglecting to comply with any provisions of §§ 1092—1118 of this title, or of any regulation, order or resolution of the Administrator issued hereunder, except for violations contained in § 1097 of this title, may be subject to an administrative fine of not less than five hundred dollars ($500) nor more than five thousand dollars ($5,000). Before imposing this fine, the Administrator shall hold a hearing before him or his agent, with full protection of the constitutional rights of the person affected by the proceeding.

The decision of the Administrator in cases covered by this subsection shall be reviewable according to the procedure established in § 1106 of this title.
