§ 1111. Unlawful commercial practices; disorganization of the market

(a) It shall be unfair business practice for any processor, sterilizer or dealer in a marketing area to sell or otherwise dispose of milk at prices which the Administrator, after due notice and opportunity of hearing before him or his designated agent, determines that it creates an emergency to disrupt or undermine or to try to disrupt and undermine the prices required hereunder to be paid by such processor, sterilizer or dealer for the milk received or bought from producers, or for putting such processor, sterilizer or dealer in jeopardy of becoming unable to pay in full and promptly for said milk.

(b) No discriminatory reduction of prices shall be made in any distribution medium. Every price reduction in any distribution medium shall be considered discriminatory and prejudicial to the public interest which is not made extensive in general to all purchasers in said distribution medium throughout all zones of operation of the processor making same. Every price reduction contemplated in any or all distribution media shall be notified to the Administrator at least ten (10) days in advance of the day it will become effective.

(c) Liquid milk shall not be sold at any level of distribution at a price other than that fixed by the Administrator for said level.
