The controvertible presumption is hereby established that any natural or juridical person who is caught transporting cattle in any type of vehicle, whether authorized or not (as said term is defined in § 861 of this title and according to the requirements for its certification to be promulgated through regulations by the Secretary of Agriculture) or on foot or by other means of transportation, outside of the hourly schedule within the period allowed for the movement of cattle as established by the Secretary through regulations, is in illegal possession and custody of said cattle. Said presumption is likewise established for those cases in which, within said hourly schedule comprising the period for the movement of cattle, said cattle is transported in unauthorized or uncertified vehicles pursuant to the regulatory provisions promulgated for such a purpose by the Secretary of Agriculture.
The Secretary of Agriculture shall establish through regulations:
(a) The means and manner by which the cattle is to be identified;
(b) the formalities that allow establishing and justifying proprietary ownership of the cattle;
(c) the formalities that allow the owners to authorize employees and/or third parties to transport their cattle so that they may be able to establish and justify legitimate ownership of said cattle;
(d) the requirements for certifying the vehicles authorized for transporting cattle, and
(e) the administrative penalties for noncompliance with said regulations.
All of the preceding for the purpose of being able to adequately implement the provisions of this chapter.
