Whenever the Secretary or his authorized representative finds, upon an inspection, any plant or plant product or vegetative material for propagation infested or infected with any harmful plant pest, he shall give written notice to such effect to the owner or person in charge of the establishment or facilities where such plant or plant product is, and the owner or person in charge shall remove and destroy the plant or plant product infested or infected, if satisfactory treatment is not possible, or shall cause the plant, plant product or vegetative material for propagation to be treated in the manner directed in the notice.
In case the owner or person in charge fails or refuses to comply with the terms of the notice, within the reasonable time established in said notice, which in no case shall be less than 48 hours, the Secretary may proceed to give treatment or to destroy the plant, plant product or vegetative material for propagation infested or infected without payment of any compensation whatsoever. The expenses incurred by the Department in such treatment or destruction shall be charged to the owner of the plant or plant product.
