(a) We hereby authorize the creation of a special fund that shall be known as the “Special Fund for the Agricultural Materials Analysis and Registration Laboratory”. The Fund shall be administered by the Department of Agriculture for the benefit of the Agricultural Materials Analysis and Registration Laboratory, known as the Agrological Laboratory. Said Fund shall receive monies from the following sources:
(1) Collection of a registration fee in the case of pesticides distributed or sold in Puerto Rico.
(2) A special tax in the case of commercial fertilizers, the raw materials of fertilizers manufactured and distributed in Puerto Rico.
(3) The inspection fee in the case of commercial feed sold or distributed locally, pursuant to what is established in the regulations that govern said products.
(4) Collection of a fee for the taking of samples and/or conducting analyses that are requested from the Agrological Laboratory, including the analysis of residues.
(5) Payment of fines imposed on those found guilty of violating the Department of Agriculture regulations that the Agrological Laboratory has the obligation of enforcing.
The income destined to said Fund shall be used for the proper operation of the “Agricultural Material Analysis and Registration Laboratory”.
(b) The Department of Agriculture shall draft and promulgate the applicable regulations for the creation and management of the Fund, and shall include the parameters for the use of available funds.
