§ 385a. Staggered implementation

The Teacher’s Retirement Board shall grant retirement for years of service rendered to all teachers of the System who so request in writing to the Retirement Board, after having practiced for a period of twenty-five (25) years or more and reached the age of fifty (50) or more.

The benefits of the Early Retirement Program previously provided in this chapter shall be implemented in a staggered manner; Provided, That during the first year of effectiveness of this act only those teachers who complete twenty-eight (28) years or more of service and have reached the age of fifty (50) or more may choose to avail themselves of the established pension. During the second year of effectiveness of this act only those teachers who complete twenty-five (25) years or more of service and have attained the age of fifty (50) or more, shall be eligible. All participants who qualify in the first year and second year of effectiveness shall request to avail themselves of the Program during the choice of retirement period provided in § 385k of this section.
