§ 705. Duties and powers

The Board shall have the following powers and faculties, without their being construed as a limitation:

(a) Advise the Governor, the Department of the Family and the government agencies which render services to the Puerto Rican family, concerning the public policy for the protection, strengthening and development of the institution of the family.

(b) Examine the responsibility imposed by law upon the government bodies in the field of protection and strengthening of the family, as well as to advise and ensure that each one fulfills its responsibility in order to achieve the greater well being of the Puerto Rican family.

(c) Provide guidelines for public and private agencies for the implementation of programs and projects related to Puerto Rican families, as well as to require that government organisms, when about to make a decision or adopt a regulation that may have a significant impact upon families, especially those participating in social welfare programs, or in which the head of the family is a woman, to evaluate prior to making the final determination whether said government action shall:

(1) Strengthen or weaken family stability.

(2) Assist the family in compliance with its duties and responsibilities, or promote that the State becomes a substitute in such duties and responsibilities.

(3) Increase or reduce family income.

(4) Be performed by the family without State intervention.

(5) Issues a tacit or implicit message to the public regarding family relationships.

The evaluation document of the proponent agency must be sent to the Advisory Board for same to issue its comments and recommendations before the agency makes the determination, or adopts the pertinent regulation. The proponent agency shall seriously consider the observations and recommendations of the Board prior to performing any final action regarding the matter.

(d) Encourage the participation of the citizenry in the development and implementation of projects and programs to benefit the Puerto Rican family and expedite their communication with public agencies.

(e) Coordinate the resources and facilities of government and private agencies required for the proper strengthening, development and protection of the Puerto Rican family.

(f) Encourage studies regarding matters related to the family to be carried out by the Government agencies and the community.

(g) Evaluate those matters related to the strengthening and protection of the Puerto Rican family and set forth the recommendations it understands are proper to ensure compliance with the public policy for promoting the welfare of the family. To these ends it will designate the special committees it deems necessary and pertinent.

(h) Prepare and submit to the Governor and to the President of the Senate and the Speaker of the House of Representatives, an annual report on the state of the family, including the achievements obtained and its recommendations; and any other special reports that are required.
