Any natural or juridical person who sends or brings any child or who causes any child to be sent or brought to Puerto Rico to be placed for adoption or in foster care, who fails to comply with the requirements established in this chapter, shall be punished with a fixed term of imprisonment of two (2) years or a fine of not less than five thousand dollars ($5,000) nor of more than ten thousand dollars ($10,000), or both penalties at the discretion of the court. Should aggravating circumstances exist, the penalty established may be increased for up to a maximum of three (3) years, or a fine of not less than five thousand dollars ($5,000) nor of more than fifteen thousand dollars ($15,000), or both penalties at the discretion of court. Should extenuating circumstances exist, the penalty established may be reduced to a minimum of six (6) months, or a fine of not less than five thousand dollars ($5,000) nor of more than seven thousand dollars ($7,000), or both penalties at the discretion of the court.
