The Division shall determine whether the applicant is eligible for public assistance under the provisions of §§ 1–26 of this title, the type and amount of public assistance he shall receive, and the date upon which such public assistance shall begin. Payments shall be made in the manner prescribed by the Division; Provided, That in those cases in which the beneficiary is, by reason of advanced age or physical or mental disability, incapacitated to cash his/her check and to administer the assistance awarded, the Division may appoint as custodian a person of legal age of recognized moral solvency. The check shall be drawn in the name of this custodian, who shall be charged with cashing it and administering the assistance for the good of the beneficiary, under the supervision of this Division.
