Section 146.550 - Definitions for KRS 146.550 to 146.570As used in KRS 146.550 to 146.570:
(1) "Wetlands" means land that has a predominance of hydric soils and is inundated or saturated by surface or groundwater at a frequency and duration sufficient to support, and that under normal circumstances does support, a prevalence of hydrophytic vegetation typically adapted for life in saturated soil conditions;(2) "Hydric soils" means soils that, in their undrained condition, are saturated, flooded, or ponded long enough during the growing season to develop an anaerobic condition that supports the growth and regeneration of hydrophytic vegetation;(3) "Hydrophytic vegetation" means a plant growing in water or a substrate that is at least periodically deficient of oxygen during the growing season as a result of excess water content;(4) "Office" means the Office of Kentucky Nature Preserves; and(5) "Cabinet" means the Energy and Environment Cabinet.Amended by 2018 Ky.
