Section 53-5a08 - Authority to refuse to perform notarial act(a) A notarial officer may refuse to perform a notarial act if the officer is not satisfied that the: (1) Individual executing the record is competent or has the capacity to execute the record; or(2) individual's signature is knowingly and voluntarily made.(b) A notarial officer may refuse to perform a notarial act unless refusal is prohibited by the law of this state or by federal law.(c) This section shall take effect on and after January 1, 2022.Added by L. 2021, ch. 64,§ 8, eff. 1/1/2022.
