Section 5-10.4-7-12 - Recovery of amounts due from school corporation(a) If a school corporation fails to make the payments required by this chapter, the amount payable may be:(1) withheld by the state comptroller from money payable to the school corporation and transferred to the fund; or(2) recovered in a suit in the circuit or superior court of the county in which the school corporation is located.(b) The suit described in subsection (a)(2) shall be:(1) an action by the state on the relation of the board; and(2) prosecuted by the attorney general.Pre-2006 Education Finance Recodification Citation: 21-6.1-7-13.
