Section 4-3-27-6 - Terms of office; vacancies(a) Except as provided in subsections (b) and (c), members shall be appointed to the cabinet for four (4) year terms. A four (4) year term expires as follows: (1) For a member appointed under section 5(a)(9) through 5(a)(17) of this chapter, December 31, 2025, and every fourth year thereafter.(2) For a member appointed under section 5(a)(18) through 5(a)(23) of this chapter or under section 5(a)(28) of this chapter, December 31, 2027, and every fourth year thereafter. The governor must rotate appointments described in section 5(a)(9) and 5(a)(10) of this chapter so that the same research university, comprehensive university, or independent college is not represented on the cabinet for two (2) consecutive terms.
(b) The members of the general assembly appointed under section 5(a)(26) or 5(a)(27) of this chapter serve two (2) year terms that expire June 30 of an odd-numbered year. The appropriate appointing authority shall fill a vacancy among the legislative members of the cabinet.(c) The chairperson appointed under section 5 of this chapter serves at the pleasure of the governor.(d) For members appointed by the governor, the governor shall promptly make an appointment to fill any vacancy on the cabinet, but only for the duration of the unexpired term.Amended by P.L. 42-2024,SEC. 29, eff. 3/11/2024.Amended by P.L. 132-2020,SEC. 3, eff. 7/1/2020.Amended by P.L. 143-2019,SEC. 4, eff. 7/1/2019.Added by P.L. 152-2018,SEC. 1, eff. 3/21/2018.
