Section 4-15-2.2-33 - Certification and placement of individuals with a disability(a) As used in this section, "individual with a disability" means an individual:(1) with a physical or mental impairment that substantially limits one (1) or more of the major life activities of the individual; or(2) who:(B) is regarded as; having an impairment described in subdivision (1).
(b) Notwithstanding any other provision of this chapter, an Indiana rehabilitation facility or the division of disability and rehabilitative services may certify that an individual:(1) is an individual with a disability; and(2) possesses the required knowledge, skill, and ability to perform the essential functions of a position classification:(A) with or without reasonable accommodation; or(B) with special accommodation for supported employment.(c) An applicant with a disability who is certified under subsection (b) may be appointed to a position in a classification for which the applicant is certified.Added by P.L. 229-2011, SEC. 56, eff. 7/1/2011.
