Section 4-12-17-1 - State agency contingency fund established; use of money; nonreverting; transfers prohibited(a) The state agency contingency fund is established for the purpose of allotting money to departments, institutions, and state agencies for the purposes set forth in subsection (b). The fund consists of money appropriated to the fund by the general assembly. The budget agency shall administer the fund.(b) Money in the fund may be used only with the approval of the governor for:(2) fringe benefit increases;(3) an employee leave conversion program;(4) state retiree health programs;(5) necessary expenses for existing programs as determined by the governor and budget director; and(6) any related expenses.(c) Money in the fund at the end of a state fiscal year does not revert to the state general fund but remains available for expenditure.(d) Notwithstanding IC 4-9.1-1-7, IC 4-13-2-23, or any other law, money may not be transferred, assigned, reassigned, or otherwise removed from the fund by the state board of finance, the budget agency, or any other state agency, except for the purposes specified in this section.
