Section 36-4-3-11.6 - Attorney's fees and costs for prevailing remonstrators(a) This section applies to a remonstrance filed after June 30, 2015.(b) If the court orders an annexation not to take place after a hearing under section 11 of this chapter, the remonstrators shall be reimbursed by the annexing municipality for any reasonable attorney's fees, including litigation expenses and appeal costs:(1) that are incurred: (A) after the date the annexation ordinance is adopted; and(B) in remonstrating against the annexation; and(2) not to exceed thirty-seven thousand five hundred dollars ($37,500).Added by P.L. 228-2015, SEC. 17, eff. 7/1/2015.
