Section 32-34-1.5-48 - Filing claims for property(a) A person claiming to be the owner of property held under this chapter by the attorney general may file a claim for the property on a form prescribed by the attorney general. The claimant must verify the claim as to its completeness and accuracy.(b) The attorney general may waive the requirement in subsection (a) and may pay or deliver property directly to a person if:(1) the person receiving the property or payment is shown to be the apparent owner included on a report filed under section 18 of this chapter;(2) the attorney general reasonably believes the person is entitled to receive the property or payment; and(3) the property has a value of less than five thousand dollars ($5,000).(c) A person may file a claim under subsection (a) at any time not later than twenty-five (25) years after the date on which the property is presumed abandoned under this chapter, notwithstanding the expiration of any other time period specified by statute, contract, or court order during which an action or a proceeding may be commenced or enforced to obtain payment of a claim for money or recovery of property.Amended by P.L. 101-2023,SEC. 7, eff. 7/1/2023.Added by P.L. 141-2021,SEC. 20, eff. 7/1/2021.
