Section 24-4.4-3-109 - Civil action by department to enjoin deceptive act(1) As used in this section, "deceptive act" means an act or a practice in which a person knowingly or intentionally: (a) makes a material misrepresentation concerning; or(b) conceals material information regarding the terms or conditions of; a first lien mortgage transaction.
(2) For purposes of this section, "knowingly" means having actual knowledge at the time of the transaction.(3) The department may bring a civil action to enjoin a deceptive act performed in connection with a first lien mortgage transaction.As added by P.L. 145-2008, SEC.20.
