Section 16-19-10-7 - Medical or epidemiological information; form of disclosure; consent(a) This section does not apply to medical or epidemiological information protected from disclosure under IC 16-41-8-1 or data or information that is confidential under IC 16-21-6-7 or IC 16-39-5-3.(b) Except as provided in subsection (c), medical or epidemiological information: (1) collected from or volunteered by a person; and(2) that results in or from: (A) a public health surveillance; (B) a public health investigation; or(C) an epidemiological investigation or study; may be released only in a form that protects the identity of a person whose medical or epidemiological information was obtained.
(c) Medical or epidemiological information described in subsection (b) may be released in a form that does not protect the identity of a person whose medical or epidemiological information was obtained if: (1) the person consents in writing to the release of the person's medical or epidemiological information; or(2) the investigation or study results in an administrative or a judicial proceeding and release of the medical or epidemiological information is ordered by, before July 1, 2020, the administrative law judge, after June 30, 2020, the administrative law judge (as defined in IC 4-21.5-1-2), or the court.Amended by P.L. 205-2019,SEC. 18, eff. 7/1/2019.As added by P.L. 261-2003, SEC.15.
