Section 15-16-5-49 - Licensed applicators and pest inspectors; licensed applicator for hire and licensed pest inspector(a) Except as provided in subsection (b), a person may not: (1) act as an employee of a licensed pesticide business and use or supervise the use of a restricted use pesticide or use a general use pesticide or fertilizer material for hire on another person's property; or(2) make diagnostic inspections or reports to determine infestations of wood destroying pests on another person's property; without having obtained a license to act as a licensed applicator for hire or a licensed pest inspector from the state chemist.
(b) A person who is not a licensed applicator for hire may use a restricted use pesticide under the direct supervision of a licensed applicator (as described in 40 CFR 171.201). A general use pesticide or fertilizer material may be used by a person who is a registered technician.(c) An applicator's license and a pest inspector's license does not relieve the person from the responsibility of obtaining any other license or permit required for the operation or use of any equipment.Pre-2008 Recodification Citation: 15-3-3.6-7.
