Section 750 ILCS 46/615 - Consequences of declining genetic testing(a) An order for genetic testing is enforceable through a proceeding for adjudication of contempt.(b) If an individual whose parentage is being determined declines to submit to genetic testing ordered by the court or administrative agency, the court or administrative agency may adjudicate parentage contrary to the position of that individual.(c) Genetic testing of the mother of a child is not a condition precedent to genetically testing the child and a man whose paternity is being determined. If the mother is unavailable or declines to submit to genetic testing, the court or administrative agency may order the genetic testing of the child and every man whose paternity is being adjudicated.Added by P.A. 099-0085,§ 615, eff. 1/1/2016.
