(b) Any occupational therapist or occupational therapy assistant who has permitted the license to expire or who has had the license on inactive status may have the license restored by making application to the Department, by filing proof acceptable to the Department of the licensee's fitness to have the license restored, by paying the required fee, and by showing proof of compliance with any continuing education requirements. Proof of fitness may include sworn evidence certifying to active practice in another jurisdiction. If the occupational therapist or occupational therapy assistant has not maintained an active practice in another jurisdiction satisfactory to the Department, the Department shall determine, by an evaluation program established by rule, the licensee's fitness to resume active status and shall establish procedures and requirements for restoration.
