Section 305 ILCS 5/10-26.5 - Delayed payment from State Disbursement Unit(a) In this Section, "adversely affected recipient of support" means a person who meets all of the following criteria: (1) The person is entitled to disbursement of a child support payment from the State Disbursement Unit.(2) The person either (i) does not receive from the State Disbursement Unit a disbursement of a child support payment to which he or she is entitled or (ii) receives a delayed disbursement of a child support payment from the State Disbursement Unit.(3) As a result of the nonreceipt of the disbursement of the child support payment or the delayed disbursement of the child support payment, the person receives an adverse rating by a credit reporting agency based, for example, on the person's inability to make a timely payment of an amount owed to another person.(b) Upon the request of an adversely affected recipient of support, the Illinois Department shall send a letter to the recipient verifying the delayed or undisbursed child support payment. The recipient may submit that letter to the appropriate credit reporting agency for placement in the recipient's credit file.(c) The Illinois Department shall adopt rules necessary to implement this Section.
