Section 65 ILCS 5/7-1-5.1 - Conditions - Tract within territory sought to be annexed(a) This Section shall apply when the following conditions are met with respect to any tract within the territory sought to be annexed: (1) the tract is commercial or industrial property;(2) the tract is owned by a single owner;(3) the tract is all or part of a parcel that lies on both sides of the Illinois and Michigan Canal;(4) the tract is all or part of a parcel containing more than 800 acres; and(5) the tract is located entirely within a county having a population of at least 300,000 but not more than 400,000.(b) If the conditions of subsection (a) are met, then the following shall apply: (1) Notwithstanding the provisions of Section 7-1-2, the notice of the annexation petition or ordinance, as the case may be, shall be given by the petitioner or corporate authorities, as the case may be, by publishing such notice in one newspaper of general circulation for 3 consecutive days, the third day of publication being not less than 30 and not more than 45 days prior to the date fixed for the hearing.(2) Every owner of record of commercial or industrial property of 50 acres or more which lies within the territory to be annexed shall be notified by the petitioner or corporate authorities, as the case may be, by certified mail, of the public hearing, any meeting of the corporate authorities where a vote is to be taken in regard to the proposed annexation, and any impending referendum to annex, at least 30 days prior to any such public hearing, meeting, or referendum.(3) Notwithstanding the provisions of Section 7-1-5, the ordinance shall be enacted not less than 30 and not more than 45 days after the public hearing.(4) No territory shall be annexed by any proceeding which does not require the consent of the owner of record unless at least one-third of such territory is used and occupied for residential purposes at the time of annexation.
