Section 124B-106 - Waiver of right to appeal; withdrawal of appeal(a) After entry of judgment in a general or special court-martial, in accordance with rules adopted by the governor or adjutant general, the accused may waive the right to appeal. A waiver shall be: (1) Signed by the accused and by defense counsel; and(2) Attached to the record of trial.(b) In a general or special court-martial, the accused may voluntarily request dismissal of an appeal at any time in accordance with the Hawaii rules of appellate procedure.(c) A waiver or voluntary dismissal under this section bars review under section 124B-111.Added by L 2022, c 286,§ 2, eff. 1/1/2023.
