Section 403.769 - Permits for used oil processing and rerefining facilities(1) Each person who intends to operate, modify, or close a used oil processing facility shall obtain an operation or closure permit from the department prior to operating, modifying, or closing the facility.(2) The department shall develop a permitting system for used oil processing facilities after reviewing and considering the applicability of the permit system for hazardous waste treatment, storage, or disposal facilities.(3) Permits shall not be required under this section for the burning of used oil as a fuel, provided: (a) A valid department air permit is in effect for the facility; and(b) The facility burns used oil in accordance with applicable United States Environmental Protection Agency regulations, local government regulations, and the requirements of its department air permit.(4) No permit is required under this section for the use of used oil for the beneficiation or flotation of phosphate rock, but may be subject to other applicable federal or state used oil rules.s. 37, ch. 88-130; s. 51, ch. 93-207; s.31, ch. 2000-211.
