Section 400.9977 - Assistance with medication(1) Notwithstanding any provision of part I of chapter 464, the Nurse Practice Act, unlicensed direct care services staff who provide services to clients in a facility licensed under this part may administer prescribed, prepackaged, and premeasured medications after the completion of training in medication administration and under the general supervision of a registered nurse as provided under this section and applicable rules.(2) Training required by this section and applicable rules shall be conducted by a registered nurse licensed under chapter 464, a physician licensed under chapter 458 or chapter 459, or a pharmacist licensed under chapter 465.(3) A facility that allows unlicensed direct care service staff to administer medications pursuant to this section shall: (a) Develop and implement policies and procedures that include a plan to ensure the safe handling, storage, and administration of prescription medications.(b) Maintain written evidence of the expressed and informed consent for each client.(c) Maintain a copy of the written prescription, including the name of the medication, the dosage, and the administration schedule and termination date.(d) Maintain documentation of compliance with required training.(4) The agency shall adopt rules to implement this section.Added by 2015 Fla.
