D.C. Code § 1-1162.15

Section 1-1162.15 - Disposition
(a) Following the presentation of evidence to the Board by the Director of Government Ethics in an adversary proceeding and an open hearing, the Board may take one or more of the following actions:
(1) Levy a penalty in accordance with § 1-1162.21;
(2) Refer the matter to the prosecutorial authority with jurisdiction for enforcement or prosecution; or
(3) [Repealed by 2020 Amendment.]
(4) Dismiss the action.
(b) The Board may refer information concerning an alleged violation of the Code of Conduct or of this title to the prosecutorial authority with jurisdiction for enforcement or prosecution after the presentation of evidence by the Director of Government Ethics to the Board as provided in section 212(b), 213(e), or 214(a).".
